Acceptance of Terms

By accessing or using Special Education Law at specialedlaw.com and specialeducationlaw.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

By clicking "I agree," creating an account, subscribing to a paid plan, or otherwise using the Site, you consent to enter into this agreement electronically, and you agree that your electronic acceptance has the same legal effect as a handwritten signature.

Eligibility

You may browse public decisions without an account. To create an account or purchase a paid subscription, you must be at least 18 years old and able to form a binding contract. By creating an account or subscribing, you represent that you meet these requirements.

Description of Service

Special Education Law provides a searchable database of special education administrative decisions and rulings from multiple jurisdictions, along with related research tools. Some features are available free of charge; others, including certain AI-assisted research features, multi-jurisdiction access, and the MCP connector, may require a paid subscription. The Site is intended for informational and research purposes only.

IMPORTANT: The information provided on this Site does not constitute legal advice.

The BSEA decisions and rulings available through this Site are public documents provided for informational purposes only. Reading or searching these documents does not create an attorney-client relationship. If you need legal advice regarding special education matters, you should consult with a qualified attorney.

AI-Assisted Research

Some features generate answers using artificial intelligence and machine-learning models. These AI-generated answers:

  • are produced by automated systems and may be incomplete, out of date, or incorrect, and may occasionally state things that are not true;
  • do not constitute legal advice and do not create an attorney-client relationship; and
  • must be independently verified against primary sources before you rely on them.

You are solely responsible for any decisions you make based on AI-generated answers. AI features are provided "as is," and we make no warranty as to their accuracy or completeness.

Accuracy of Information

While we strive to provide accurate and up-to-date information, we make no warranties or representations about the completeness, accuracy, reliability, or availability of the decisions and rulings on this Site. The official source for BSEA decisions is the Massachusetts Division of Administrative Law Appeals.

User Accounts

You may create an account to access additional features such as saving decisions to folders and receiving notifications about new decisions. You can sign in using your Google account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

Subscriptions, Fees, and Billing

We offer one or more paid subscription plans ("Pro") that unlock additional features. By subscribing, you agree to the following:

  • Fees and payment. You agree to pay the fees listed at the time you subscribe. Payments are processed by our third-party payment processor, Stripe; we do not receive or store your full payment card details. You authorize us and Stripe to charge your payment method on a recurring basis.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected) at the then-current price, until you cancel.
  • Cancellation. You may cancel at any time through the billing portal in your account settings. Cancellation takes effect at the end of your current billing period, and you retain access until then.
  • Refunds. Fees are non-refundable, and we do not provide refunds or credits for partial billing periods or unused features, except where required by law.
  • Price changes.We may change subscription prices. We will give you at least 30 days' notice before a price change takes effect on renewal; if you do not agree, you may cancel before the change takes effect.
  • Promotional codes. Any discounts or promotional codes are subject to their stated terms and may be modified or withdrawn.
  • Taxes. Fees are exclusive of taxes; you are responsible for any applicable sales, use, or similar taxes.
  • Failed payments. If a payment fails or a charge is reversed, we may suspend or downgrade your access to paid features until the amount is paid.

Email Communications

By creating an account, you agree to receive the following email communications:

  • Notifications when new BSEA decisions and rulings are posted to the Site — you may unsubscribe from these at any time via the link in each email

We may also offer an optional email newsletter. Subscribing to the newsletter is entirely voluntary and is not required to use the Site. You may unsubscribe from the newsletter at any time.

Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site or its systems
  • Interfere with or disrupt the Site's operation
  • Use automated tools to scrape or download large amounts of data without permission
  • Reproduce, distribute, or sell the Site's database or content commercially
  • Use the AI-assisted features to generate unlawful, infringing, or harmful content
  • Submit another person's confidential information, or personal information about a child, into search boxes or AI prompts
  • Use the Site, its outputs, or its data to build a competing product or to train a machine-learning model
  • Exceed any rate limits or usage limits, or access the Site through automated means except as we expressly permit

MCP Connector

We offer a Model Context Protocol (MCP) connector that lets AI assistants run read-only research over our public corpus of decisions (see our connector documentation). The connector is provided "as is," is subject to the Acceptable Use restrictions above and to reasonable rate limits, and may be changed, limited, or discontinued at any time. Access to the connector may be offered on its own or as part of a paid plan.

Intellectual Property

The Site's design, code, and organization are owned by Special Education Law. BSEA decisions and rulings are public documents and are not subject to our copyright. You may use the public documents for personal, educational, and research purposes. Subject to these Terms, you may use the answers generated for you by our AI features for your own research, but they are provided without warranty as described below.

Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS INCLUDES, WITHOUT LIMITATION, ANY AI-GENERATED ANSWERS AND ANY FEATURES THAT RELY ON THIRD-PARTY SERVICES. WE DO NOT WARRANT THAT ANY AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPECIAL EDUCATION LAW AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless Special Education Law and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your submissions to our search or AI features, or your violation of these Terms.

Modification or Discontinuation of Service

We may add, change, suspend, or discontinue any part of the Site, including features, jurisdictions, or AI capabilities, at any time, with or without notice. We will not be liable to you for any such change or discontinuation.

Suspension and Termination

We may suspend or terminate your access to the Site or your account, in whole or in part, if you violate these Terms, if we reasonably believe your use poses a security or legal risk, or if we are required to do so by law. If we terminate a paid subscription because you breached these Terms, you will not be entitled to a refund. You may stop using the Site at any time; if you have a paid subscription, the cancellation and refund terms above apply.

Third-Party Services

The Site relies on third-party services, including Anthropic (AI), Stripe (payments), and our hosting and infrastructure providers. We are not responsible for the acts, omissions, availability, or content of these third parties, and your use of features that depend on them may also be subject to their terms.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Site after changes constitutes acceptance of the new Terms. For material changes, we will take reasonable steps to notify you, such as by posting a notice on the Site or emailing you.

Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. You agree that any dispute not otherwise resolved will be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, including in connection with a merger, acquisition, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Special Education Law regarding the Site and supersede any prior agreements on that subject.

Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, outages of third-party services, network or hardware failures, or governmental actions.
