DECISION

Held: Request for Interim Order dismissed, without prejudice, as moot.

Date: October 14, 1994

In this case the petitioning parent is seeking the following for her daughter:

1. a specific fire safety exit plan.

2. changes in the scheduling of bathroom breaks.

3. better explanation of the need for some items included in the student's IEP.

At the hearing the school district presented a fire safety exit plan which it had developed in cooperation with the local Fire Department for this student. The district also submitted a plan for bathroom breaks which meets the students current needs and which will probably meet her needs in the future. The School Department has also offered, with mediation help from the Department of Education, to explain the need for some items included in the student IEP.

Conclusion

There is no need for an Interim Protective Order at this time. This case is therefore dismissed, without prejudice, as moot.
