STATEMENT OF THE CASE
The matter was filed in the state Office of Special Education Programs and transmitted to the Office of Administrative Law (OAL) on May 19, 2023. The matter was scheduled for a Zoom © technology settlement conference on May 26, 2023. Petitioner failed to appear, however, settlement negotiations continued. The undersigned contacted the petitioner this date and counsel for respondent, the parties confirmed the matter could be withdrawn as the matter has been resolved.
ORDER
I ORDER petitioner’s petition filed in this matter is withdrawn on consent on June 22, 2023.
This decision is final pursuant to 20 U.S.C.A. § 1415(i)(1)(A) and 34 C.F.R. § 300.514 (2016) and is appealable by filing a complaint and bringing a civil action either in the Law Division of the Superior Court of New Jersey or in a district court of the United States. 20 U.S.C.A. § 1415(i)(2); 34 C.F.R. § 300.516 (2016). If the parent or adult student feels that this decision is not being fully implemented with respect to program or services, this concern should be communicated in writing to the Director, Office of Special Education Programs.
