ISSUES:

1. Is the Psychological Evaluation appropriate?

2. If not, are the Parents entitled to an independent psychoeducational evaluation at public expense?

PROCEDURAL HISTORY/SUMMARY:

The Board filed the Due Process Complaint and Request for Hearing on March 15, 2021. The Hearing Officer was appointed on March 16, 2021. A Prehearing Conference was scheduled for April 12, 2021. A hearing date was scheduled for May 19, 2021; however, due to illness the hearing date was postponed until June 14 and the mailing date was extended. On June 12, the Hearing Officer was notified that the Parents were withdrawing their request for IEE, and the Board withdrew its request for Due Process.

This case is DISMISSED.
