ISSUES:

1. Is the surrogate Parent entitled to an independent psychological evaluation and Functional Behavior Assessment at District expense?

PROCEDURAL HISTORY/SUMMARY:

The District filed the Due Process Complaint and Request for Hearing on January 22, 2021. The Hearing Officer was appointed on January 28, 2021. A Prehearing Conference was scheduled for February 8, 2021. The parties indicated they had a resolution in progress and the Hearing Officer was notified via email that the District was withdrawing its request for a Due Process Hearing.

This case is DISMISSED without prejudice.
