ISSUES:
1. Did the Board fail to provide the Student FAPE during the 2018-19 school year, and fail to implement the IEP, when it a) did not implement reading intervention; b) did not begin transportation until May 2019; c) failed to provide a math teacher during ESY 2019; and d) failed to provide required assistive technology?
2. Did the July 31, 2019 IEP fail to offer the Student FAPE?
3. Did the Board commit procedural violations during the February 27, 2020 PPT that resulted in denying the Parents an opportunity to equally participate in decisions concerning their child's education and did those violations deny the Student FAPE?
4. Did the February 27, 2020 IEP fail to offer the Student FAPE?
5. Was the program provided by the parents through Gold Coast appropriate, and should the Parents be reimbursed for all expenses associated with that program, including transportation from August 2018 through ESY 20201?
6. Is compensatory education appropriate?
PROCEDURAL HISTORY/SUMMARY:
The Student is entitled to receive a free and appropriate public education in the least restrictive environment as defined in the Individuals with Disabilities Education Improvement Act (“IDEA”) §20 U. S. C. 1401 et seq. and Connecticut General Statutes §10-76a et seq. The Parents filed the Due Process Hearing Complaint on January 7, 2021. The Hearing Officer was appointed on January 7, 2021. At the pre-hearing conference held on January 21, 2021 hearings were scheduled for March 15, 16 and 18, 202. The date for the final memorandum of decision was set for March 23, 2021. The Parents filed a motion for stay put order on February 15, 2021. The Parents withdrew their complaint on February 23, 2021.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
