5. If the District has deprived the Student of FAPE and the program at Options is an appropriate one, should the District be ordered to place the Student at Options for the 2020-21 school year?
6. If the District has deprived the Student of FAPE, should compensatory education be ordered?
SUMMARY AND PROCEDURAL HISTORY:
Case 21-0103 was commenced by the Parents by request received by the District on September 8, 2020. A prehearing conference was held on September 24, 2020. At the prehearing conference, hearing dates was set for November 4, 2020 and November 5, 2020 and the decision date was determined to be November 20, 2020. The November 4, 2020 date was not noticed due to a scheduling problem that developed subsequent to the conference and the other date was later cancelled.
On November 4, 2020, the undersigned hearing officer was advised by the attorney for the Parents that the parties had reached a resolution and that the matter was being withdrawn with prejudice.
FINAL DECISION AND ORDER:
The matter is dismissed with prejudice.
