ISSUES:

1. Did the District deprive the Student FAPE for the 2020-21 school year by failing to offer an appropriate program?

2. If the District has failed to offer FAPE, is Hubbard Day an appropriate placement for the Student?

3. If the District has failed to offer FAPE and Hubbard Day is an appropriate placement, should the District be ordered to reimburse the Parents for the tuition and other costs of the Student’s placement at Hubbard Day?

SUMMARY AND PROCEDURAL HISTORY:

Case 21-0093 was commenced by the Parents by request received by the Board on September 1, 2020. A prehearing conference was held on September 18, 2020. At the prehearing conference, a hearing date was set for October 14, 2020 and the decision date was determined to be November 13, 2020.

On October 5, 2020, the undersigned hearing officer was advised by the attorney for the Parents that the matter was being withdrawn by them with prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
