ISSUES:

1. Did the Board offer an appropriate program for the 2017-18, 2018-19, 2019-20 school years including the 2018, 2019 and 2020 extended school years?

2. If not, is placement at Franklin School the appropriate program for the Student for the 2020-21 school year and should the Board be ordered to place the Student at Franklin School for the 2020-21 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought their Hearing Request on July 28, 2020. The Hearing Officer was appointed July 29, 2020. A Prehearing Telephone Conference took place on August 19, 2020. A hearing on the matter was subsequently scheduled for October 5, 2020.

On September 9, 2020, the Parents informed the Hearing Officer that they were withdrawing their request for a Due Process Hearing with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
