ISSUES:

1. Did the Board deny FAPE for the 2019-2020 school year, including ESY

2020, by failing to conduct thorough Transition Evaluations, and by failing to extend IDEA entitlement to the 2020-2021 school year in accordance with Court Order and BSE Guidance?

2. If so, should the Board be ordered to continue Student’s IDEA eligibility through June 13, 2021, and to reimburse Parents for costs incurred?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought their Hearing Request on June 30, 2020. The Hearing Officer was appointed July 8, 2020. A Prehearing Telephone Conference took place on July 31, 2020. A hearing on the matter was subsequently scheduled for September 10, 2020.

On August 11, 2020, the Parents informed the Hearing Officer that they were withdrawing their request for a Due Process Hearing without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
