ISSUES:

1. Did the District fail to offer the Student a program and placement that would provide her with a free appropriate public education for the 2019-2020 school year?

2. If not, is The Marvelwood School an appropriate placement?

3. If so, are the Parents entitled to reimbursement for costs associated with the unilateral placement at The Marvelwood School?

4. Should the Board be ordered to place the Student at The Marvelwood School?

5. Did the Board violate any procedural rights of the Parents?

6. Should compensatory education be awarded as a remedy?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed their Due Process Complaint and Request for Hearing on March 10, 2020. The Hearing Officer was appointed on March 12, 2020. A Prehearing Conference was noticed for and held on April 9, 2020. On July 21, 2020, via email, the Attorney for the parents withdrew their request for a Due Process Hearing based on the settlement of this matter and requested that it be dismissed with prejudice.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
