ISSUES:

1. Did the Board offer an appropriate program for the 2017-18 school year including the 2018 extended school year?

2. Did the Board offer an appropriate program for the 2018-19 school year including the 2019 extended school year?

3. Did the Board offer an appropriate program for the 2019-20 school year including the 2020 extended school year?

4. If not, is placement at The Valley View School the appropriate program for the Student for the 2019-20 school year, and should the Board be ordered to place the Student at The Valley View School for the 2019-20 school year?

5. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought the initial Due Process Complaint and Hearing Request on October 11, 2019. The Hearing Officer was appointed on October 16, 2019. A Prehearing Telephone Conference took place on November 1, 2019.

A hearing was scheduled for December 16, 2019.

On December 11, 2019, the Parents’ attorney notified the Hearing Officer that the parties had reached an agreement and that the Parents were withdrawing their request for a hearing without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED
