6. Whether the Board should be required to pay for the Southport School for the 2018-2019 school year starting from January 2019?

7. Whether the Board should be required to pay for the Southport School for the 2019-2020 school year for failure to propose an appropriate program?

8. Whether the Board should be ordered to pay for additional years in the form of compensatory education at the Southport School for failing to provide or offer FAPE?

PROCEDURAL HISTORY/SUMMARY:

The Due Process Complaint was filed on October 1, 2019. The Hearing Officer was appointed on October 1, 2019. A Prehearing Conference was noticed for and held on October 10, 2019. On November 19, 2019, via email, counsel for the Parents withdrew the matter with prejudice, based on the settlement of this matter.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
