ISSUES:

1. Whether the Board failed to meet its responsibilities to evaluate and determine whether Student is in need of services (“child find”) during the school years of 2017-2018 and 2018-2019?

2. Whether the Student was denied a Free and Appropriate Public Education (“FAPE”) by the Board for the school years 2017-2018, 2018-2019?

3. Whether the Board should have prepared, and provided services to Student according to, an Individualized Education Plan for all above school years?

4. Whether the Student should be entitled to receive compensatory education in the areas of reading, math and writing.

5. Whether Student's Parents are entitled to compensation for money they have expended for tutoring and other services which were not provided to Student?

PROCEDURAL BACKGROUND:

The Student, represented by the parent, initiated this special education due process case on September 10, 2019. The Hearing Officer was assigned to the case on September 11, 2019. A Prehearing Conference was convened on September 20, 2019 which was attended by the Parents and the Board's attorney. A hearing date was set for November 6, 2019 with the deadline for filing the final decision November 25, 2019. The Student retained counsel and moved to extend time for the hearing date to December 3, 2019 and extending the time for the mailing of the final decision to January 3, 2020, which motion was granted. On November 26, 2019, counsel for the Student notified the Hearing Officer and the Board's attorney that the Student wished to withdraw the case without prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED without prejudice.
