ISSUES:

1. Did the Board offer an appropriate program for the 2019-20 school year including the 2019 extended school year?

2. If not, is placement at Ben Bronz Academy the appropriate program for the Student for the 2019-20 school year and should the Board be ordered to place the Student at Ben Bronz Academy for the 2019-20 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought the initial Due Process Complaint and Hearing Request on October 24, 2019. The Hearing Officer was appointed on October 25, 2019. A Prehearing Telephone Conference took place on November 7, 2019.

A hearing was scheduled for January 2, 2019.

On December 2, 2019, the Parents’ attorney notified the Hearing Officer that the parties had settled the matter and that the Parents were withdrawing their request for a hearing with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED
