ISSUES:

1. Did the District fail to provide the Student with FAPE for the 2018-19 by offering a placement which was not appropriate?

2. If the answer to the foregoing is in the affirmative, what remedies should be ordered?

SUMMARY AND PROCEDURAL HISTORY:

Case 19-0395 was commenced by the Parents by request received by the Board on February 28, 2019. A prehearing conference was held on March 5, 2019. At the prehearing conference, a hearing date was set for April 29, 2019 and the decision date was determined to be May 14, 2019. The hearing date was later cancelled and the mailing date extended to October 11, 2019

On September 12, 2019, the undersigned hearing officer was advised by the attorney for the Parents that the parties had reached a settlement in the case and that the matter should therefore be dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
