ISSUES:
The following issues were preliminarily identified for determination at the hearing:
1. Did the Board deny the parents a meaningful opportunity to participate in the process of creating the Student’s Individual Education Program (IEP)?
2. Was the IEP dated 11/ 24/17 implemented?
3. Were related services discontinued on 11/17/17?
PROCEDURAL HISTORY:
The Student initiated this special education due process case on February 25, 2019. This Impartial Hearing Officer was assigned to the case on March 8, 2019. A Prehearing Conference was convened on March 18, 2019. The Student’s mother appeared on behalf of the Student and Attorney Linda Yoder appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case was May 10, 2019.
The parties discussed the issues presented in this case during the conference. The Student’s mother agreed to submit an Amended Request for Due Process, which she did on March 25, 2019. A second prehearing conference was scheduled for April 16, 2019.
On April 16, 2019, the Student’s mother reported that the parties had reached a settlement during a resolution meeting, and requested that the matter be withdrawn or dismissed.
FINAL DECISION AND ORDER:
The Student’s mother’s request for dismissal is granted and the matter is dismissed.
