ISSUES:
The following issues were identified for determination at the hearing:
1. Did the Board offer an appropriate program for the 2016-17, 2017-18, 2018-19 school years?
2. If not, what is the appropriate remedy?
a. Should the Board be ordered to conduct a comprehensive assessment?
b. Should the Board be ordered to conduct a specific reading evaluation?
c. Should the Board be ordered to retain Dr. Luddy as a consultant?
d. Is compensatory education appropriate?
PROCEDURAL HISTORY:
The Student initiated this special education due process case on February 11, 2019. Impartial Hearing Officer Laura Share was assigned to the case. A Prehearing Conference was convened on March 6, 2019. Attorney Lawrence Berliner appeared on behalf of the Student and Attorney Marsha Moses appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is April 26, 2019. An evidentiary hearing was scheduled for March 26, 2019. On March 7, 2019, Hearing Officer Laura Share recused herself from the case. Consequently, it was assigned to Hearing Officer Ann Bird.
On March 19, 2019 the Student reported that the matter had been resolved and requested that the matter be dismissed.
FINAL DECISION AND ORDER:
The Student’s request for dismissal is granted. The case is hereby dismissed.
