ISSUES:

1. Was an appropriate program offered to the Student by the Stamford Board of Education for the 2016-2017, 2017-2018 and 2018-2019 school years?

2. If the Student was denied FAPE, what is the remedy?

3. Is the Board responsible for payment of the IEE requested at the September 20, 2016 PPT?

4. Is the Student entitled to compensatory education and/or any other relief deemed appropriate by the Hearing Officer?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed the Due Process Complaint and Request for Hearing on September 6, 2018. The Hearing Officer was appointed on September 13, 2018. A Prehearing Conference was scheduled for September 20, 2018. The parties agreed on hearing dates in October and November. The Hearing Officer was notified by the parties that a settlement was close to being reached and a 30 day extension of the mailing date was granted to negotiate. The new mailing date given was December 26, 2018. As of this date, the Hearing Officer has not had any communications from either party.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
