ISSUES:

(1) Does the December 6, 2017 PPT’s recommended placement of the Student in an O/D program offer the Student FAPE in the least restrictive environment?

(2) If not, is Shelton High School an appropriate placement for the Student?

PROCEDURAL HISTORY/SUMMARY:

The Parent brought the Due Process Complaint and Hearing Request on July 2, 2018; the Hearing Officer was appointed on the same day. A Prehearing Telephone Conference took place on July 6, 2018. The Parent did not participate in this conference. Following that conference, an initial hearing was scheduled for July 30, 2018. On July 18, 2018, the Board requested that the scheduled hearing be continued. The Hearing Officer denied this request, but scheduled a second prehearing conference call which took place on July 23, 2018. The Parent participated in this conference. Following the conference call, the hearing was rescheduled for August 20, 2018, for 10:00am. The hearing convened on August 20, 2018. The Parent failed to appear. The petition was dismissed.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
