ISSUES:

1. Did the Board provide an appropriate program for the 2017-2017 school year?

2. Did the Board propose an appropriate program on December 19, 2017?

3. If not, is the Southport School appropriate?

4. If so, should the Board be required to reimburse Parents for the educational related expenses at Southport School?

5. Do the circumstances warrant an award of compensatory education?

6. If so, should the Parents be reimbursed for their expenses for Dr. Levinson and for private reading instruction at Lindamood-Bell after August 31, 2017?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed the Due Process Complaint and Request for Hearing on April 13, 2018. The Hearing Officer was appointed on April 17, 2018 and conducted a Prehearing Conference on May 3, 2018. The Hearing Officer granted the Parents’ request for extension of the Mailing Date of the Final Decision and scheduled hearing for July 11, 2018. On June 26, 2018, the Parents withdrew the Hearing Request without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED without prejudice.
