ISSUES:

The issues are as stated in the Board’s Request for a Due Process Hearing pursuant to 34 C.F.R. 300.502(b)(2)(i).

PROCEDURAL HISTORY/SUMMARY:

The student is entitled to receive a free and appropriate public education in the least restrictive environment as defined in the Individuals with Disabilities Education Improvement Act (“IDEA”) §20 U. S. C. 1401 et seq. and Connecticut General Statutes § 10-76a et seq.

The District filed an Expedited Due Process Hearing Complaint on April 12, 2018. The Hearing Officer was appointed on April 17, 2018. The District withdrew its complaint without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED without prejudice.
