ISSUES:
a) Did the District fail to provide the student with a FAPE for the 2017-2018 school year?
(b) Did the District fail to provide the student with a FAPE for the 2016-2017 school year?
(c) Did the District fail to provide the student with a FAPE for the 2015-2016 school year?
(d) If so, then are the parents entitled to compensatory education for student’s unilateral placement at the Kildonan School for the 2017-2018 school year?
(e) If so, then are the parents entitled to reimbursement for the private evaluation?
PROCEDURAL HISTORY:
The Parents initiated this special education due process matter, Case No. 18-0278, on or about January 16, 2018. This Impartial Hearing Officer was assigned to the case on January 16, 2018. A Prehearing Conference was convened on January 22, 2018. Attorney Griswold appeared on behalf of the student, and the Board of Education was represented by Attorney Santiago. During the conference, the parties indicated they would be participating in mediation. The Parents, through counsel, on March 24, 2018, reported that the parties had drafted an agreement and they were withdrawing their due process complaint.
FINAL DECISION AND ORDER:
The matter is DISMISSED with prejudice.
