ISSUES:
1. Did the Board of Education offer the Student a free appropriate public education for the 2017-2018 School Year?
a. If not, is Eagle Hill School appropriate?
b. If Eagle Hill School is appropriate, should the Student be reimbursed for the expense of her matriculation there?
c. If Eagle Hill School is not appropriate, is the Student entitled to compensatory education services?
PROCEDURAL HISTORY:
The Student initiated this special education due process case on October 25, 2017. This Impartial Hearing Officer was assigned to the case on October 26, 2017. A Prehearing Conference was convened on November 9, 2017. Attorney Jillian Griswold appeared on behalf of the Student and Attorney Michelle Laubin appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is January 8, 2018. An evidentiary hearing was scheduled for December 19, 2017.
On December 15, 2017, the parties reported that they had resolved the dispute and the Student requested that the matter be withdrawn or dismissed without prejudice.
FINAL DECISION AND ORDER:
It is ordered that the Student’s request is granted and the matter is dismissed without prejudice.
