ISSUES:

1. Did the Board offer an appropriate program for the 2017-2018 school year?

2. If not, is Thames Academy appropriate?

3. If so, should the Board be required to financially support Student’s placement at Thames Academy?

4. Should the Board be required to reimburse Parents for the education related expenses for their unilateral placement of Student at Thames Academy?

5. Should the Board be required to reimburse Parents for Dr. Mayville’s evaluation?

PROCEDURAL HISTORY/SUMMARY:

The Parent filed the Due Process Complaint and Request for Hearing on June 29, 2017. The Hearing Officer was appointed on July 6, 2017 and conducted a Prehearing Conference on July 21, 2017 and granted the Parents’ request for extension of the Mailing Date of the Final Decision in order to engage in mediation. The Mailing Date of the Final Decision was extended to October 12, 2017. The hearing was scheduled for September 29, 2017. On September 22, 2017, the Parent’s attorney reported to the Hearing Officer that the parties had settled the dispute and that the Parent was withdrawing the matter with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
