ISSUES:

Does the Student require a home based developmental program with extended day programing to receive a free and appropriate public education (FAPE)?

SUMMARY AND PROCEDURAL HISTORY:

The Student is classified with Autism and is entitled to receive a free and appropriate public education (FAPE) as defined in the Individuals with Disabilities Improvement Act (IDEA) 20 U.S.C. §1401 et seq. and Connecticut General Statute §10-76a et seq.

At a planning and placement team (PPT) meeting, the Parents disagreed with the program offered by the Board and requested an intensive home-based developmental program for the Student. The Board denied the Parent’s request. An impartial hearing officer was appointed on April 20, 2017 and a pre-hearing conference was scheduled for May 2, 2017.

In an electronic transmission, the parties informed the hearing officer that the matter had been resolved and withdrew the matter with prejudice.

The date for the mailing the Final Decision and Order is July 3, 2017.

FINAL DECISION AND ORDER:

THE MATTER IS DISMISSED WITH PREJUDICE.
