ISSUES:

1. Is the Student entitled to reimbursement from public funds for the assessment performed by Dr. Cherkes-Julkowski in 2012?

2. Is the Student entitled to reimbursement from public funds for the assessment performed by Dr. Cherkes-Julkowski in 2013?

PROCEDURAL HISTORY:

The Board of Education filed this due process case on January 2, 2014 in response to the Student’s request for reimbursement for evaluations, in order to establish that its evaluation of the Student was appropriate. A prehearing conference was held on January 6, 2014 and evidentiary hearings were scheduled for March 4 and 5, 2014. On January 6, 2014, Counsel for the Student submitted a written request for a thirty-day postponement and extension of the timelines to conduct the hearing and to file the final decision in this case to March 14, 2014. That request was granted. At the hearing on March 4, 2014, the Board of Education reported that the Student withdrew the request for reimbursement and requested that the Impartial Hearing Officer dismiss the matter.

FINAL DECISION AND ORDER:

It is ordered that the Board of Education’s request for dismissal is granted and this matter is dismissed.
