ISSUE:
Did the Meriden Board of Education provide the Student with a free appropriate public education?
PROCEDURAL HISTORY:
The Student’s Parent filed this due process case on August 14, 2013. This Impartial Hearing Officer was appointed to the matter on August 20, 2013. On August 21, 2013, the Meriden Board of Education reported to the Impartial Hearing Officer that the matter had been settled at a resolution meeting, with the Student’s Parent signing a written agreement. This Impartial Hearing Officer wrote to the Student’s Parent On August 23, 2013 via United States Mail, postage prepaid, addressed to the Parent’s address of record, inquiring whether the report of a settlement was accurate and whether she wished to ! pursue the case. The Student’s Parent did not respond to the letter. The letter was not returned to the Impartial Hearing Officer. Again, on September 11, 2013, this Impartial Hearing Officer wrote to the Student’s Parent at the address of record via United States Mail, postage prepaid, asking the Parent to indicate whether the case should be dismissed on or before September 27, 2013. The Impartial Hearing Officer warned that the matter would be dismissed if the Parent did not respond by that date. Again, the Parent did not respond to the letter, Nor was the letter returned to the Impartial Hearing Officer.
FINAL DECISION AND ORDER:
It is ordered that the Parent’s request for due process is dismissed for failure to prosecute.
