ISSUES:
1. Did the Stonington Board of Education (“Board”) provide a free and appropriate public education (“FAPE”) to the Student for the academic year of 2011-2012, commencing from July 2011 forward?
2. Did the Board provide a FAPE to the Student for the 2012-2013 academic years?
3. Was the Student entitled to an extended school year for either or both of those academic years?
4. Is the proposed individualized education program for the 2013-2014 academic year appropriate?
5. If the answer to Issue 4 is no, does the Student require a private placement and if so, is the Learning Clinic the appropriate placement?
6. If the Board is found to have denied the Student a FAPE for any or all of the above issues, what is the appropriate remedy? ti
PROCEDURAL HISTORY:
The complaint was filed on July 5, 2013 (by agreement of the Parties). A pre-hearing conference was held on July 30, 2013, from which the issues above were identified. A due process hearing date was set for September 17, 2013, which necessitated an extension of the original final hearing and decision date to October 21, 2013. The parties participated in mediation on August 19, 2013, in which the issues were settled. On August 20, 2013, Counsel for the Parents withdrew the complaint with prejudice.
FINAL DECISION AND ORDER:
The complaint was withdrawn by the Parents on August 20, 2013, following a successful mediation session on August 19, 2013. With no further issues to be decided in this matter before the Hearing Officer, this matter is DISMISSED with prejudice.
