ISSUES:

1. Whether the Student’s conduct which resulted in the disciplinary action was caused by or had a direct and substantial relationship to the Student’s disability, or whether the conduct in question was the direct result of the Board’s failure to implement the Student’s IEP;

2. Whether a PPT meeting shall immediately convene to determine an appropriate placement for the Student, pending placement in a 45 day diagnostic setting which the team has already recommended.

PROCEDURAL HISTORY/DISCUSSION:

This request for an expedited hearing was received on February 20, 2013 and a prehearing conference convened on February 25, 2013. After the prehearing conference, the Parent’s attorney submitted notification that the Parent withdraws the request for due process with prejudice because the Parent and the Board have reached a settlement agreement. Therefore, this matter is dismissed.

FINAL DECISION AND ORDER:

The matter is DISMISSED
