ISSUES:

1. Did the Board propose an educational placement that would have provided the Student a free appropriate public education in the least restrictive environment for the / 2009-2010 school year?

2. If not, should the Parents be reimbursed for tuition covering the unilateral placement of the Student at Villa Maria School for the 2009-2010 school year?

3. Should the Parents be reimbursed for tuition covering the continued placement of the Student at Villa Maria School in Stamford for the 2010-2011 school year?

SUMMARY:

A special education hearing in the above-captioned matter was requested by the Parents and received by the Board on August 22, 2012. A pre-hearing conference in which Attorney Braxton appeared for the Parents and Attorney Wadler appeared for the Board was held by telephone on September 12, 2012. After Attorney Braxton’s request for an extension was granted, the deadline for mailing the final decision and order was extended to December 5, 2012. On: November 21, 2012, the Parent withdrew the Request for Due Process.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
