FINAL DECISION AND ORDER

ISSUES:

1. Whether the Board’s programs for the Student for the 2010-11 and 2011-12 school years were appropriate;

2. Whether the Board’s proposed program for the Student for the 2012-13 school year is appropriate;

3. Whether the Parents’ proposed placement for the Student at Ben Bronz Academy is appropriate; °,

4. Whether the Parents shall be reimbursed for the summer 2012 Ben Bronz Academy program (including mileage) and services provided by Dyslexia Institute;

5. Whether the Student is entitled to two years of compensatory education,

PROCEDURAL HISTORY/DISCUSSION:

The request for hearing was received by the Board on August 16, 2012 and a prehearing conference convened on August 24, 2012.

On August 31, 2012 the Parents’ attorney submitted notification that the parties in this matter have executed a settlement agreement and that the Parents are withdrawing their request for hearing with prejudice. Therefore, this matter is dismissed.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
