ISSUES:
1. Whether the Board failed to provide/offer FAPE to the Student for the 2010-11, 2011-12 and 2012-13 school years;
2. Whether the Parents’ unilateral placement of the Student at Carmel Academy with related services is appropriate;
3. Whether the Student is entitled to compensatory education.
PROCEDURAL HISTORY/DISCUSSION:
This request for hearing was received by the Board on August 3, 2012 and a prehearing conference convened on August 21, 2012. The mailing date of the decision was extended at the request of the Board’s attorney to provide the parties with additional time to attempt to settle this case through mediation. On October 18, 2012, prior to the first hearing date, the Parents’ attorney submitted notification that a settlement agreement had been signed and that they were withdrawing this case with prejudice. Therefore, this matter is dismissed.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
