ISSUES:

1. Whether the Board violated its obligation to implement PPT recommendations in a timely fashion; and, if so,

2. Whether such violation deprived the Student of a free, appropriate public education in the least restrictive environment for the 2011-2012 school year.

SUMMARY:

On May 8, 2012, the Board received the Request for Due Process. On May 17, 2012, a pre-hearing conference was held and hearing dates were scheduled. On May 25, 2012, in accordance with the terms of a settlement agreement between the parties, the Parent withdrew the Request for Due Process.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
