ISSUES:
1. Whether the program offered to the Student for ESY 2011 was appropriate;
2. If not, whether the Parents’ supplementary program for the Student for ESY 2011 was appropriate and shall be reimbursed;
3. Whether the Board’s program for the Student for the 2011-12 school year is appropriate; a
4. If not, whether the Parents shall be reimbursed for the private counseling, OT and PT services they provided to the Student;
5. Whether the Student is entitled to compensatory education;
6. Whether the Board’s occupational therapy evaluation of the Student is appropriate;
7. Whether the Board shall pay for an independent evaluation of behavior and an OT evaluation for the Student.
PROCEDURAL HISTORY/DISCUSSION:
The first request for hearing filed by the Board (Case No. 12-0168) was received by the Parents on November 15, 2011 and a prehearing conference convened on November 23. 2012, Subsequently, on December 9, 2012, the Parents filed a request for hearing (Case No. 12-0213), and a prehearing conference convened on December: 19, 2012. The two cases were consolidated on December 28, 2012 under Case No. 12-0213, On January 20, 2012, prior to the first hearing date of January 24, 2012 both parties submitted notification that the case was settled. Therefore, this matter is dismissed.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
