ISSUES:

1. Did the Board of Education offer the Student a free appropriate public education for the 2011-12 School Year and/or ESY 2011?

2. If not, is the Student’s placement appropriate?

3. If so, is the Student entitled to reimbursement for the expense of his placement, including transportation?

4. Is the Student entitled to compensatory education? ,

PROCEDURAL HISTORY:

The Student submitted a Request for Impartial Special Education Hearing on January 12, 2012. The Hearing Officer was assigned to the case on January 17, 2012. Telephonic prehearing conferences were conducted on February 3 and February 27, 2012. A hearing date of April 9, 2012 was scheduled. On February 27, 2012, Counsel for the Student requested a thirty-day extension of the timelines for conducting the hearing and issuing the final decision and order. The request was granted and the deadlines were extended to April 26, 2012. On April 4, 2012, Counsel for the Student notified the Hearing Officer that the Student’s Request for Due Process Hearing was withdrawn. As a result, the Hearing Officer canceled the hearing.

FINAL DECISION AND ORDER:

It is ordered that this case shall be dismissed with prejudice.
