ISSUES:

1. Whether the Board’s proposed program for the Student for the 2011-12 school year is appropriate

2. If not, whether the Parents’ proposed placement of the Student at Eagle Hill is appropriate and shall be reimbursed.

PROCEDURAL HISTOR Y/DISCUSSION:

This request for hearing was received by the Board on July 25, the date of the prehearing conference. The Board had not received a copy of the request by the prehearing conference, so the hearing officer forwarded a copy to the Board on that date.

The hearing convened on September 22, with the Parents’ attorney, the Parent, the Board representatives and the Board’s attorney present. At the hearing, the parties finalized an agreement, and reported that the case was settled. The Parents’ attorney requested that the case be withdrawn with prejudice. Therefore, this case is dismissed.

FINAL DECISION AND ORDER:

The matter is DISMISSED, with prejudice.
