ISSUES:

1. Whether the Board failed to provide a free appropriate public education to the Student from May 24, 2010 to February 28, 2011;

2. Whether the program for the Student proposed by the Board at the PPT meeting on December 10, 2010 was appropriate;

3. Whether the Parent’s placement of the Student at Winston Prep commencing on February 28, 2011 is appropriate;

4. Whether the Parent shall be reimbursed for the tuition for Winston prep and related transportation costs;

5. Whether the Parent shall be reimbursed for the evaluations completed by Dr. Carol Fiorile and Dr. Cornelia Gallo;

6. Whether the Student is entitled to compensatory education.

PROCEDURAL HISTORY/DISCUSSION:

This request for hearing was received by the Board on March 9, 2011 and a prehearing conference convened on March 17, 2011. A request to extend the mailing date was submitted and granted to allow the parties an opportunity to mediate this case. On May 18, 2011 prior to the first hearing date, the Parents’ attorney submitted notification that the mediation agreement was executed, and requested that the matter be withdrawn with prejudice. Therefore, this matter is dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED, with prejudice.
