ISSUES:

1. Whether the Board’s proposed after school program at CCCD as set forth in the November 20, 2010 IEP is appropriate.

2. Whether the Parents’ proposed extended school day home program is appropriate.

3. Whether the Student is entitled to compensatory education.

PROCEDURAL HISTORY/DISCUSSION:

This request for hearing was received by the Board on February 24, 2011. A prehearing conference convened on March 9, 2011 and the hearing was scheduled to convene on May 11, 2011.

Prior to the first hearing date, the Parents’ attorney submitted notification that the case had settled. In accordance with that notice, this matter will be dismissed without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
