ISSUES:
1. Whether the PPT erred in its decision that the student’s behavior for which discipline was imposed was not a manifestation of his disability; and
2. Whether the Student should return to school and a PPT convened in order to amend his IEP and to create a behavioral intervention plan.
SUMMARY:
On February 24, 2011, the Board received the Request for Due Process. A Prehearing Conference was held on March 3, 2011 and hearing dates were scheduled. On March 3, 2011, the Board filed a Sufficiency Challenge. On March 8, 2011, the Parent/Student filed an Amended Request for Due Process. On March 8, 2011 the Hearing Officer found that the filing of the Amended Request rendered the Sufficiency Challenge moot. On March 15, 2011, Counsel for the Parent/Student withdrew the Request for Due Process.
FINAL DECISION AND ORDER:
The matter is DISMISSED,
