FINAL DECISION AND ORDER
A special education hearing in the above-captioned matter was requested by Student’s Guardian via Request for Impartial Special Education Hearing dated November 16, 2010.[1] The following issues are identified:
1. Did the Board of Education fail to properly provide Student’s Parents with procedural safeguards?
2. Did the Board of Education fail to provide Student with a free appropriate public education during the 2008-09, 2009-10, 2010-11 school years?
3. Should Student be placed in a private special education program at the Board of Education’s expense?
The thirty-day resolution period ran through December 16 and the deadline for mailing the final decision and order is January 30, 2011.
A pre-hearing conference was scheduled for December 3. On December 2, the Board of Education’s Director of Psychological Services notified the Hearing Officer that a resolution session was held on November 29, that a resolution agreement was being signed on December 2, and that Student’s Guardian indicated that she notified the parties that she withdraws the request for hearing. The Hearing Officer received no request for withdrawal. Neither party appeared for the pre-hearing conference.
FINAL DECISION AND ORDER
In light of the above facts, the above-captioned case is hereby dismissed.
