ISSUES:

1. Whether the Board failed to offer FAPE to the Student for the 2010-2011 school year;

2. Whether the Student should be placed at a Private Day Placement;

3. Whether the Student should be placed at the Intensive Education Academy (IEA);

4. Whether the Board should pay for the Student’s placement at IEA.

SUMMARY:

On July 1, 2010, the Board received the Request for Due Process. On July 29, 2010, a Prehearing Conference was held and hearing dates were scheduled. On August 12, 2010, the Parent withdrew the Request for Due Process without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED without prejudice.
