ISSUES:

1. Did the Board provide the Student with an appropriate program for the 2008-2009 school year?

2. Did the Board provide the Student with an appropriate program for the 2009-2010 school year?

3. Was the Board’s proposed program in an out-of-district placement appropriate for the Student for the 2010-2011 school year?

4. If not, should the Board provide the Student with an extended school year program for 2010 and for the 2010-2011 school year in the public high school?

5. Should the Board provide independent evaluators and consultants to develop an appropriate program for the Student in the public high school?

6. Is the Student is entitled to compensatory education for any period of time?

PROCEDURAL HISTORY:

The Parents’ attorney faxed a letter on June 4, 2010 to the Board’s Director of Pupil Personnel Services requesting a due process hearing. A copy was sent on that date to the State Department of Education. Another hearing officer was assigned to the case on June 9, 2010. On June 14, 2010, the Parents’ filed a Motion to Consolidate requesting that this case be consolidated with a case filed by the Board against the Parents, which was assigned to this Hearing Officer. The Board objected to consolidating that case with the other hearing officer because of the emergency nature of the Board’s due process request. On June 17, 2010, after conferring with the other hearing officer, she referred this case to this Hearing Officer. The Parents’ Motion to Consolidate was granted. A prehearing conference was held on July 2, 2010. One hearing date was agreed on for July 21, 2010. The mailing date for the final decision was set at August 18, 2010.

On July 12, 2010, the Parents’ attorney advised the Hearing Officer that the parties had settled both cases at a resolution session on July 7, 2010 and that the Parents were withdrawing this hearing request.

FINAL DECISION AND ORDER:

It is ordered that this case shall be dismissed.
