ISSUE:

1. Whether the behavior that has resulted in the pending disciplinary action was caused by or had a direct and substantial relationship to the Student’s disability, or whether the conduct in question was a direct result of the Board’s failure to implement the IEP.

SUMMARY:

The Board received this expedited request for hearing on May 6, 2010 and a prehearing conference was convened on May 10, 2010. On May 26, 2010, the Parent/Guardian submitted notification that the parties had come to a mutual agreement regarding this matter.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
