A special education hearing in the above-captioned matter was requested by the Student’s Parents via Request for Impartial Special Education Hearing dated April 29, 2010.[1] The thirty-day resolution period runs through May 29 and the deadline for mailing the final decision and order is July 13, 2010. The request for hearing indicates that Student’s Parents disagree with a PPT decision regarding math and reading instruction for Student during summer 2010 and that they were refused the opportunity to add input to the Student and Parent Input and Comments Section of Student’s Individualized Education Plan. A pre-hearing conference was scheduled by the Hearing Officer for May 18. Pursuant to the agreement of the parties, it was rescheduled for May 24. On May 19, Student’s Parents sent the Hearing Officer an e-mail indicating that they would like to withdraw the request for due process hearing without prejudice because they are in over their heads. They indicated that they now realize that Student needs a reading evaluation, which will not be done until the end of May with results ready in June.
FINAL DECISION AND ORDER:
In light of the above facts, the above-captioned case is hereby dismissed without prejudice and the May 24 pre-hearing conference is cancelled.
