ISSUES:

1. Whether the Board failed to provide the Student with FAPE for the 2009-10 school year.

2. Whether the Student is entitled to compensatory education.

3. Whether the Board failed to provide the Student with FAPE for the period of 2/11/10 to the end of the 2009-10 school year.

4. Whether the Parents shall be reimbursed for the placement of the Student at Grove School and the related cost of transportation.

SUMMARY:

The Board received this request for hearing on April 16, 2010, and a prehearing conference convened on April 26, 2010. The hearing convened on August 9, 2010 and August 24, 2010. On the second hearing date, the Parents’ attorney reported that the case had settled. This matter is dismissed with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED, with prejudice.
