ISSUES:

1. Whether the Board failed to offer the Student FAPE for the 2009-2010 school year;

2. Whether the Student requires a twenty-four hour residential program for educational purposes, for the 2009-2010 school year.

SUMMARY:

The Board received this request for hearing filed by the Parent on July 15, 2009. A Pre-Hearing Conference was held on August 11, 2009 and Hearing dates were scheduled. On August 12, 2009, pursuant to the Request of the Parents, the deadline for mailing the Final Decision and Order was extended to November 16, 2009. On October 22, 2009, Counsel for the Parents notified the Hearing Officer that an interim agreement had been reached and withdrew the Request for Due Process without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
