ISSUES:

The Board’s issues for the hearing are:

1. Whether the Student shall be placed in a residential placement in the absence of parental consent.

2. Whether the Student’s records shall be released so that the Board can make application to residential placement facilities.

The Parents’ issues are:

1. Whether the Board has provided the Student with an appropriate program.

2. Whether the Parents’ objection to the residential placement is appropriate, and whether the Student shall be placed in a less restrictive setting.

SUMMARY:

Hearing requests were filed for both parties, and a mailing date of the decision was calculated from the receipt date of the hearing request of June 23, 2009.

A prehearing conference convened on July 2, 2009 and a hearing date was scheduled for August 7, 2009. Prior to the first hearing date, the Board’s attorney reported that both cases were settled.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
