ISSUES:

1. Whether the Board’s evaluation of the Student was appropriate.

SUMMARY:

The Board submitted this request on May 1, 2009. The Parent submitted a notice that they would like to withdraw their request for an independent educational evaluation [IEE] to the hearing officer on May 14, 2009. The prehearing conference convened on May 18, 2009, as no notice was received from the Board was not proceeding with this case. Due to the parties’ unavailability, a second prehearing conference was scheduled. After the second scheduled prehearing conference on May 21, 2009 the Board submitted a notice that it is no longer proceeding in this case in light of the Parent’s withdrawal of the request for an IEE.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
