ISSUES:

1. Whether the School failed to identify the Student as eligible for Special Education Services;

2. Whether the Student should be placed at Kildonan School in New York;

3. Whether the Board should reimburse the Parents for the all expenses incurred in placing the Student at Kildonan;

4. Whether there were procedural violations;

5. Whether compensatory education should be provided to the Student.

SUMMARY:

The Board received this request for hearing filed by the Parent on April 21, 2009. A Pre-Hearing Conference was held on May 13, 2009 and June 1, 2009; and Hearing Dates were scheduled. On June 8, 2009, Counsel for the Parent and Student withdrew the matter without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
